1. Acceptance of Terms

Welcome to AskEveryone. These Terms of Service ("Terms") govern your access to and use of the AskEveryone website, applications, and services (collectively, the "Service"), operated by AskEveryone (a DBA). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. Material changes will be announced in-product or by email, and the "Last Updated" date at the top will be revised. Continued use of the Service after an update constitutes acceptance of the new Terms.

2. The Service

AskEveryone is an audience-feedback platform. Creators ("Askers") create a space, publish questions to their audience, collect text or voice responses, and receive AI-generated syntheses, themes, quotes, advice, and related content. Respondents answer questions privately and anonymously. Some spaces are operated by AskEveryone itself ("Community" spaces) and are open to the general public.

Features include, without limitation:

  • Creator spaces with custom branding, distribution tools, and team access.
  • Text and voice responses from audiences.
  • AI-generated syntheses, advice, question suggestions, blog posts, and podcasts.
  • Integrations with YouTube, Beehiiv, and Kit for creator-content ingestion and audience engagement.
  • CSV import for existing survey or focus-group responses.
  • Email distribution, embed widgets, and public results pages.
  • Paid subscription tiers with usage limits and premium features.

We may add, modify, or discontinue features at any time. Some features are released as beta and may change or be removed without notice.

3. Eligibility

Minimum age to use AskEveryone:

  • United States: 13 years old.
  • European Union / EEA: 16 years old, or your country's age of digital consent (13–16).
  • United Kingdom: 13 years old.
  • Elsewhere: The minimum age for digital services in your country, or 13, whichever is higher.

If you are under the age of majority in your country, you must have a parent or legal guardian's permission. By using the Service you represent that you meet these requirements, have the legal capacity to enter these Terms, will comply with these Terms and all applicable laws, and have not been previously suspended from the Service.

4. Accounts

4.1 Respondent use

You do not need an account to respond to most questions. If you choose to create one, or if you use "returning audience" tracking on a creator's space, Section 4.2 applies.

4.2 Creator accounts

Creator accounts are created by signing in with Google, Apple, or a passkey. You must provide accurate information and keep it current. You are responsible for all activity that occurs under your account, for keeping your credentials secure, and for not sharing access except through our team-member features.

4.3 Team members

Creators can invite team members to their space with roles of Owner, Admin, or Viewer. The Owner is responsible for their team's compliance with these Terms. Removing a team member immediately revokes their access.

4.4 Termination

You can delete your account at any time by contacting support@askeveryone.io. We may suspend or terminate accounts that violate these Terms, engage in fraud or abuse, or create legal or security risk for AskEveryone or its users.

5. Subscriptions and Billing

5.1 Plans

AskEveryone offers a free tier and paid subscription tiers (Starter, Pro, and Studio). Each tier has usage limits and features described on our pricing page. We may change plan pricing, limits, or features from time to time; existing subscribers will be notified before a material change takes effect.

5.2 Payment

Payments are processed by Stripe. By subscribing, you authorize recurring charges to your chosen payment method at the stated price and billing interval until you cancel. You are responsible for all applicable taxes.

5.3 Cancellation and refunds

You can cancel at any time from your billing settings. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then. Fees are non-refundable. We do not provide partial refunds for unused time on a subscription, downgrade credits, or refunds for months in which the Service was used. We may make exceptions at our sole discretion.

5.4 Usage limits

Each plan has monthly usage limits (for example, number of responses collected). If you exceed your plan's limits, we may restrict certain features until you upgrade or the limits reset. Community spaces operated by AskEveryone are not subject to creator usage limits.

5.5 Failed payments

If a payment fails, we will attempt to notify you and retry the charge. Continued non-payment may result in downgrade to the free tier or suspension of paid features.

6. Respondent Content

6.1 License to your responses

When you submit a response (text or voice), you grant AskEveryone and the creator whose question you answered a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, store, modify, analyze, publish, display, and distribute that response in connection with the Service, including:

  • Displaying your response (without identifying information) to the creator and, if the creator publishes results, to the public.
  • Including your response in aggregate statistics, themes, quotes, and AI-generated syntheses.
  • Running AI models on your response to analyze sentiment, extract themes, and generate advice or content.
  • Using anonymized or aggregated data for research, product improvement, and public reporting.

You retain ownership of your content. This license survives deletion of your account because individual anonymous responses cannot be located and removed by account.

6.2 Response rules

  • Text responses are typically 10–5,000 characters.
  • Voice responses must not exceed platform limits for length and file size.
  • Responses should be relevant to the question asked.
  • Do not submit duplicate responses, use bots, or attempt to manipulate results.

6.3 Prohibited content

Do not submit content that:

  • Is illegal, fraudulent, defamatory, obscene, or sexually explicit involving minors.
  • Contains hate speech, threats, harassment, or incitement to violence.
  • Infringes intellectual property, privacy, or publicity rights.
  • Contains malware or attempts to exploit the Service.
  • Includes unsolicited advertising, spam, or promotional material.
  • Impersonates another person or misrepresents affiliation.
  • Contains personal information about other people without their consent.

6.4 Voice recording consent

By submitting a voice recording, you confirm that you are the person speaking, consent to local in-browser transcription of your voice, and grant the license in Section 6.1 for both the audio and the transcript. Voice recording is always optional.

7. Creator Content and Responsibilities

7.1 Your content

Creators own the questions, branding, configuration, and content they upload to their space. By uploading content to AskEveryone — including questions, logos, imported CSV responses, and any content from connected sources such as your website, RSS feed, YouTube channel, Beehiiv, or Kit — you grant AskEveryone a worldwide, non-exclusive, royalty-free license to host, reproduce, process, summarize, index, and display that content as needed to operate the Service for you, including feeding it to AI models to generate questions, syntheses, and related outputs.

7.2 Representations about content you upload

You represent and warrant that:

  • You own or have all necessary rights, consents, and permissions to upload the content and to grant the license above.
  • Your content and use of the Service do not violate any law, contract, or third-party right.
  • Any responses you import via CSV were collected with the respondents' consent and in a way that allows you to process them through AskEveryone and its AI subprocessors.
  • Content you ingest from connected sources (website, RSS, YouTube, Beehiiv, Kit) is content you are authorized to use for this purpose.

7.3 Audience communications

If you use AskEveryone to send email to your audience (for example, question notifications or results announcements), you are responsible for compliance with anti-spam laws (CAN-SPAM, CASL, GDPR, etc.), including obtaining any required consent and honoring unsubscribe requests.

7.4 Publishing results

Creators control whether a synthesis is published publicly, both at the space level and per-synthesis. If you publish results publicly, you are responsible for ensuring that doing so is appropriate for your audience and the content they submitted. You can unpublish at any time.

7.5 Third-party platforms

When you connect a third-party service (YouTube, Beehiiv, Kit, etc.), you must comply with that platform's terms of service. We may disable an integration if required by a third-party platform.

8. AI-Generated Content

AskEveryone uses AI models (including Google Gemini, Anthropic Claude via OpenRouter, and OpenAI for text-to-speech) to produce syntheses, themes, quotes, advice, question suggestions, blog posts, and podcasts. AI output is automatically generated and can be incomplete, inaccurate, biased, or misleading.

Not professional advice. AI output on AskEveryone is for informational purposes only. It is not legal, medical, financial, or other professional advice. Do not rely on it for any decision where accuracy matters without independent verification.

Creators are responsible for reviewing AI output before publishing it or acting on it. We do not use your responses or creator content to train third-party AI models.

9. Acceptable Use

You agree not to:

  • Use the Service to violate any law or third-party right.
  • Attempt to access accounts, data, or systems you are not authorized to access.
  • Interfere with or disrupt the Service, including by bypassing rate limits, captcha, or other protective measures.
  • Scrape, crawl, or harvest data from the Service except as permitted by a documented API.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service to send spam, run a pyramid scheme, or engage in phishing.
  • Create multiple accounts or use automation to manipulate responses, analytics, or referrals.
  • Remove, obscure, or alter any proprietary notices or branding.

10. Privacy

Our Privacy Policy explains how we collect, use, and share information. By using the Service you agree to the practices described there.

11. Third-Party Services

AskEveryone depends on third-party services including Google Cloud, Stripe, Resend, Cloudflare Turnstile, Plausible, Google Gemini, OpenRouter/Anthropic, OpenAI, YouTube, Beehiiv, and Kit. Your use of those services through AskEveryone is also subject to their terms. We are not responsible for the availability, accuracy, or conduct of any third-party service, and an integration may change or be discontinued at any time.

12. Intellectual Property

The Service, its design, code, text, graphics, logos, and trademarks are owned by AskEveryone and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service, reverse engineer it, or use our branding without written permission.

The license you grant us in Sections 6.1 and 7.1 does not transfer ownership of your content to us.

13. DMCA

If you believe content on the Service infringes your copyright, send a DMCA notice to dmca@askeveryone.io with: a description of the copyrighted work, the location of the alleged infringing material, your contact information, a statement of good-faith belief that the use is not authorized, a statement under penalty of perjury that your notice is accurate, and your physical or electronic signature. We will investigate and take appropriate action.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the maximum extent permitted by law, AskEveryone disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, uninterrupted operation, and security of data. We do not warrant that the Service will meet your requirements, that AI output will be accurate or useful, or that the Service will be free of errors or interruptions.

User-submitted content reflects the views of individual users and does not represent AskEveryone. We do not endorse, verify, or guarantee any user content.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASKEVERYONE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total aggregate liability for all claims arising from or related to the Service will not exceed the greater of (a) $100 USD or (b) the amount you paid AskEveryone in the twelve months preceding the claim. Some jurisdictions do not allow certain exclusions; in those jurisdictions, our liability is limited to the maximum extent permitted.

16. Indemnification

You agree to indemnify, defend, and hold harmless AskEveryone and its owners, officers, employees, and agents from any claim, liability, damage, loss, cost, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your content, your violation of these Terms, your violation of any third-party right, or your violation of applicable law.

17. Dispute Resolution and Arbitration

Informal resolution. Before filing a claim, contact legal@askeveryone.io and attempt in good faith to resolve the dispute informally for at least 30 days.

Binding arbitration. Any dispute not resolved informally will be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, conducted in English in the United States. The arbitrator's decision is final and binding.

Class action waiver. Disputes must be brought on an individual basis. You waive any right to participate in a class action or class-wide arbitration.

Exceptions. Either party may seek injunctive or equitable relief in court to protect intellectual property or prevent unauthorized use of the Service.

18. Governing Law

These Terms are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-law principles. For disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in California.

19. Export Controls

You agree to comply with all applicable export and sanctions laws. You represent that you are not located in a country subject to US government embargo and are not on any US government list of prohibited or restricted parties.

20. Miscellaneous

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and AskEveryone about the Service.
  • Severability. If any provision is found unenforceable, the rest remains in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of that provision.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign them without restriction.
  • Survival. Sections on content license, intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law survive termination.
